Terms & Conditions

Please read the following terms and conditions carefully and ensure your understanding before booking. References to “us”, “we”, “our”, “Pure Traveller” and/or “Pure Traveller” in these booking terms and conditions shall mean Pure Traveller Pty Ltd ABN 27 158 560 206, its officers, employees and agents.

The acceptances of all reservations are subject to these booking conditions which form a contractual relationship between Pure Traveller and its clients. It is important that clients understand these booking conditions before making a booking.

How to book Contact Johnny H direct 1300 053 001 or one of the many Johnny H Representatives’ to receive an Adventour Application. Upon receipt, we will recontact you with details about your $1000 refundable (unless departure is already guaranteed then it will be non-refundable) deposit as well as further details we need from you.

Tour Flights You agree that in the instance that flights are not included in the tour package price that you will either; agree to purchase flights on the designated tour flights are directed; or, accompany the tour participant to the agreed first day of the tour in the destination as advised by Pure Traveller. Additionally, in this instance you also agree to meet the tour group on the final day of the tour at the designated meeting place as advised by Pure Traveller to meet the travel and travel with them from that point. If you elect to organise you own flights and meet the tour group at the first tour day as designated, you are under no obligation to purchase your flights through Pure Traveller.

Responsibility Pure Traveller will not be liable for any accident, injury, delay, property damage or personal loss to you or those travelling with you in connection with any booking, transportation, or other travel service resulting directly or indirectly from any occurrence or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule. Whilst care is taken by Pure Traveller to ensure the description of all travel, facilities and services is accurate, these may be changed, upgraded, and on occasion taken out of service. Pure Traveller cannot be held liable for omissions or errors, whether temporary or permanent to any facilities and services provided by3rd parties. Pure Traveller is committed to protecting your personal information.

Prices All prices are displayed in accordance with ACCC guidelines and subject to availability and can be withdrawn or varied without notice. Prices quoted are subject to change and only guaranteed when paid in full. Price changes may occur due to increases in the cost of the product or service includes currency fluctuations, fuel surcharges, taxes and airfare charges.

Changes Changes to bookings already paid in full may incur additional costs.

Cancellation Fee (if you cancel) Subject to the Australian Consumer Law, cancellation charges for both you and your representative apply where a holiday is cancelled. Written notice of the cancellation must be given to Pure Traveller. The cancellation charges below are in addition to any payment made or owed to a third party travel service provider (eg airline, hotel, tour operator):

150 days or more prior to travel – loss of deposit

121-149 days prior to travel – 50% of total cost

120 days or less prior to travel – 100% of total cost

In the event that payment has been made to Pure Traveller Pty Ltd by credit card, you agree that you will not seek to charge back your payment to Pure Traveller Pty Ltd.

Payment of Travel The balance of the holiday price must be paid not later than 90 days prior to the departure date of the holiday. Some tours may require an earlier full payment to satisfy early payment discounts or other requirements specific to that departure You will be advised of this when you book. If payment is not made by the due date, Pure Traveller may treat you as if you have cancelled and you will be subject to the cancellation policy as outlined in these terms and conditions.

Travel Insurance Pure Traveller strongly recommends that you take out appropriate travel insurance to cover your travel arrangements, it is also necessary for all international departures. Travel insurance should be taken out when paying the deposit for your holiday. You are not obligated to engage with Pure Traveller regarding the purchase of travel insurance, but we are happy to assist if requested.

Agency Pure Traveller through its Johnny Adventours brand put together holidays but third parties may provide transport, tour, events or accommodation. It is important that you read the terms and conditions applicable to your package. Also, make sure that you are aware of any exclusions or limitations of liability imposed by the travel service providers. Pure Traveller has no liability for the products or services provided by these travel service providers, nor does Pure Traveller make or give any warranty in respect of the standard of those products or services. All bookings of holiday packages are made subject to the terms and conditions, including conditions of carriage and limitations of liability imposed by those travel service providers. Your legal rights in connection with the provision of travel services are against the specific travel service provider and, except to the extent a problem is caused by fault on the part of Pure Traveller, are not against Pure Traveller. If for any reason any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the travel service provider, not Pure Traveller.

Baggage Limits You are entitled to bring two pieces of luggage, one which does not exceed 23kg and the other, which is hand held, that does not exceed 7kg and its size accords with airline policy. Luggage limits may vary for international travel. Most importantly, you must be able to carry your own luggage.

Liability To the maximum extent permitted by law, Pure Traveller excludes all liability for direct, indirect, consequential or incidental damages (including loss arising from negligence), loss of profits or savings or damages for disappointment. The liability of Pure Traveller for breach of condition or warranty implied by law or otherwise, and which cannot be excluded, is limited to the extent possible, at the option of Pure Traveller to the supply of the services again or the payment of having the services supplied again.

Passports, Visas, Tax, Health and

Travel advice It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. If you need information regarding visa and other travel document requirements for your trip please let us know as we can obtain such information from an external visa advisory service provider on your behalf. We do not warrant the accuracy of such information and accept no liability for any loss or damage which you may suffer in reliance on it. If you wish, we can obtain visas for you through this external service and fees will apply. All quoted taxes are subject to change until tickets are issued. We strongly recommend you visit www.smartraveller.gov.au to ensure that you are aware of any health requirements for your travel and ensure that you carry all necessary vaccination documentation. Please check with your local doctor or specialist vaccination clinic.

Travel Documents Travel documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder as an incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. PLEASE ADVISE US IMMEDIATELY of any errors in names. In the case of an air ticket needing to be reissued at a later date due to a name correction, you will be liable for any fee or price change incurred. Errors in names, dates and timings on your documentation will be your responsibility if not advised at the time of booking. All travel documentation will be carried in the tour operations folder on tour at all times.

Governing Law If any dispute arises in relation to the agreement between you and us, the laws of Australia will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Australia, and waive any right that you may have to object to an action being brought in those courts.

Privacy Policy Pure Traveller is committed to protecting your personal information. We will handle your personal information in accordance with our Privacy Policy which is available at www.puretraveller.com.au. By providing personal information to us, you agree that our Privacy Policy will apply to how we handle all your personal information. Where you book an overseas holiday, it may be necessary that we disclose your personal information to foreign recipients such as foreign travel service providers. These foreign travel service providers may not be subject to Australian law. You agree that we are not required to ensure that the foreign travel service providers comply with Australian privacy laws, or are otherwise accountable for how your personal information is handled by a foreign travel service provider.

Acceptance of Risk The Client acknowledges that the tours may involve an amount of personal risk. The Client hereby assumes all such risk and does hereby release the Company from all claims and causes of action arising from any damages or injuries or death resulting from these inherent risks.

Disclosure You have disclosed to Pure Traveller every matter that is relevant to your condition which might impact upon our ability to provide you with the appropriate level of care while on the holiday. Pure Traveller cannot provide and cannot be held responsible for not providing the appropriate level of care where you fail to disclose every matter relevant to your condition.

Client Responsibility Pure Traveller reserves the right to withdraw holiday participation from anyone whose behaviour is likely to effect the smooth operation of the holiday or adversely affects the enjoyment or the safety of other travellers. Pure Traveller shall be under no liability to such a person. If you need to be sent home early, you or your guardian will bear the full cost of your return, including staff costs. You are liable for any damage to property or persons which you may have caused.

Alcohol consumption Pure Traveller special traveller tours are alcohol free. This is due to the varying medical circumstances of the tour participants.
